Federal Court Hearing Today to Address Afghan Family’s Arrest and Detention

--()--Today, the U.S. District Court for the Central District of California will hold a hearing to consider the Emergency Motion for Temporary Injunctive Relief brought by a family of five from Afghanistan, who arrived in the U.S. on Thursday in possession of Special Immigrant Visas (SIVs). Today’s hearing will address several issues, including providing meaningful access to counsel to this family and the appropriate remedies for this family’s improper arrest and detention.

The family will be represented at the hearing by lawyers from international law firm Gibson, Dunn & Crutcher LLP and Public Counsel.

The family – including the father and mother and their three young sons, ages 7, 6, and 8 months – received their visas due to the father’s work on behalf of the U.S. government in Afghanistan, where he served on an Air Force Base alongside U.S. military personnel and contractors. When the family arrived at LAX, they were immediately taken into custody and detained for more than 40 hours without access to counsel. Gibson Dunn and Public Counsel filed a habeas petition on Saturday, March 4, demanding, among other things, meaningful access to counsel for the family. The petition was filed on behalf of the International Refugee Assistance Project as a “next friend” of the family, as well as on behalf of the individual family members. Shortly after the petition was filed, the father was moved to a detention center in Orange County, California, and the mother and children were to be moved that night to a detention facility in Texas. Late on Saturday, a district judge issued a temporary restraining order, ensuring that the family could not be removed from the state of California.
