Employee Rights Firm Shegerian & Associates Proves Liability of Battelle Memorial Institute in Whistleblower Case

LOS ANGELES--()--Shegerian & Associates, Inc., a Santa Monica-based litigation law firm specializing in employee rights, was able to prove liability in a recent wrongful termination case surrounding their whistleblower client and his former place of work, Battelle Memorial Institute.

In the case, finalized November 17th, the jury ruled that Battelle Memorial Institute wrongfully terminated Shegerian & Associates client, Jay Huston, in violation of public policy and in violation of California Labor Code section 1102.5. Anthony Nguyen and Cortney Shegerian, attorneys with Shegerian & Associates, successfully demonstrated that a substantial motivating reason for Mr. Huston’s termination from Battelle Memorial Institute was his reporting of actions he found to be illegal.

The Jury stated in its verdict form that after Mr. Huston disclosed alleged wrongdoing by Battelle Memorial Institute to a government agency regarding the improper use of public government funds, Battelle Memorial Institute subsequently retaliated against Mr. Huston in violation of the law.

Mr. Huston, a veteran who suffered a back injury while on active military duty, claimed in his complaint that he also suffered ongoing discriminatory and harassing behavior by his supervisors at BMI as a result of his having to use a wheelchair.

Nguyen and Shegerian were able to prove to the jury that such behavior had taken place and that Battelle Memorial Institute was clearly in violation of whistleblower laws.
