CHICAGO--(EON: Enhanced Online News)--Neurowave Medical Technologies (Neurowave) has settled a patent infringement lawsuit against ComfortQuest, Inc. and two of its principals, Thomas Mann and Joseph Norris.
Neurowave’s complaint asserted that ComfortQuest, Mr. Mann and Mr. Norris had infringed multiple Neurowave Patents by making, having made, offering for sale, selling, and/or using transdermal neuromodulation methods and devices, including the Comfort Quest Morning Sickness Relief device (Model: CQ-P3) and the Comfort Quest Anti Motion Sickness Band (Model: CQ-M3).
Under terms of the settlement agreement, Neurowave released all claims against the ComfortQuest Parties in exchange for (i) an acknowledgement that the Neurowave patents were infringed by ComfortQuest, (ii) the removal of all unsold infringing devices from the market, and (iii) an undisclosed payment to NMT.
Farhan Hussain, Neurowave’s CEO stated, "We are satisfied with the terms of this settlement agreement and the immediate removal of all ComfortQuest products from the market. We take great pride in the rigorously tested and clinically proven value of our Transdermal Medical Devices for the treatment of multiple Emesis indications, and will continue to pursue aggressive legal action against any product that infringes on our intellectual property. Removing such products is of paramount importance to Neurowave, as it protects patients from dubious products that do not have the same clinical efficacy and safety standards that all NMT medical devices have achieved."
