FLSA is a hot topic among all employers, as they evaluate how they respond and what will happen next. A federal judge granted an injunction shortly before the rule was slated to go into effect. The Department of Labor has since filed an appeal of that injunction.
OSHA also has changes for the upcoming year, including restrictions on blanket post-incident drug-testing policies and negative action taken against employees who report on OSHA-related incidents. In order to maintain compliance, employers should take a closer look at drug testing policies after work-related incidents and reward policies around no injuries/accidents in the workplace. Instead of rewarding employees when they reach a set date of “no accidents on the job site,” employers should look into an option that rewards those who follow safety and reporting procedures. Above all, OSHA requirements mandate documentation for all issues and resolutions.
